Dawn,

I spoke to David Schrieber for about an hour and we had a fruitful discussion. I also want to say that despite some of the negative experiences I have had at Ai that overall the benefits outweigh the numerous benefits. I have made some long lasting friendships, grown professionally and spent my time well. I have an telephone interview with a development internship Monday noon.

I do believe that the facts will bear out my case and that I will get my apology from both Gerbson and Hoffman. I do not believe I have acted contrary to the Student Handbook. If I did, I would welcome any instruction that your office would have for my professional development and my development as a human being.


Friday (tomorrow) I have two classes back to back and I am assistant directing my friend Edward Farr's commercial. It's his second time around so we are hoping for a go. How about Tuesday at 10am? Hope you are well.

Dawn,

I called and left a message. I am planning on meeting David Schreiber tomorrow at 10am to discuss the matter. The two faculty members in question are Jessy Hoffman and Steve Gerbson. He reported that I tampered "work that was being uploaded by a faculty member for a school project." That is false. In fact, he tampered with work I was completing for a school project - my commercial.

An hour before my reservation, Susan Pappa called me and asked if Gerbson could use the ADR room computer in support of his Bonoroo project. She then put me on speakerphone. Mr. Gerbson assured me that his upload time would be short and would be wrapped up ahead of my arrival. I said that in that possibility it would be fine. Then he concluded his remarks by making an off color joke encouraging me to feel free afterward to view online pornography after his upload. I overlooked his offensive joke and went about my business.

His upload time got longer not shorter. I needed to do work on that computer. So without interfering with his upload at or around 7:30PM, I used the computer to finish up some work. Instead he storms in. His behavior I have detailed in a previous email. I do not care to relive the incident. It is ugly and does not flatter EDMC. Customers should not be treated with such disgust.

I am curious by what logic Mr. Gerbson and Ms. Hoffman allege I was "breaching the peace" for I was sitting quietly computing lawfully in support of my educational inquiry and professional development. I am not aware that one sitting stationary in silence with one's attention directed at the computer breached anyone's peace.

Gerbson and Hoffman state that I was rude, aggressive and non-compliant. How else is one supposed to react when two authority figures, instructors throw temper tantrums and make threats? Any reasonable man would be in their rights to be rude, aggressive and non-compliant. However, the Gerbson-Hoffman narrative is not factual for at no time did I raise my voice, stand up to confront them but rather in a civil tone told them that I was within my rights. I had the reservation. He did not. I cannot comply with orders I am not aware of and further, Gerbson and Hoffman are not my teachers and thus have no basis to claim a senior subordinate relationship.

As to violation of 14.a., even if they were my teacher, the teacher student relationship is not a command relationship. The teacher must be polite in his instruction and cannot resort to outbursts of rage. A student does not have to comply with any of the teacher's instructions unless there is a risk of life, limb or eye sight. If the instructor has a case of misconduct to bring against a student, there is a process for that. If the student fails to perform academically, there is a process for that. The bottom line is the teacher does not have an absolute authority but enjoys some limited authority based on the consent of the student as the student is again THE CUSTOMER.

This is also a stupid argument as I immediately ceased work on the Safari application and closed it effectively complying with Gerbson and Hoffman's illegal orders.

As to charges:

"14.b. Failure to comply with the direction of college officials, faculty, staff or security officers who are acting in performance of their duties."

I remind this authority, that I had the reservation. I had the right to be there not Gerbson. If Gerbson, wanted exclusive use the facility he should have rented it. Further he went back on his word, when his upload time got longer and longer. Third, his upload failed anyway when the 9PM reservation rebooted the computer.

15.e.vi. Use of computing facilities to interfere with the work of another student, faculty member, or school official.

This charge is a re-hash of previous charges. The facts impeach the thrust of his case and do not merit any further argument. The witnesses to this affair are Steve Gerbson, Susan Pappa, Chris McKee, and Jessy Hoffman. The facts of the case will exonerate me. But this repeated incidences of trampling on the customer, the student, and an uneven application of justice bear out a strong case of bias against heterosexual men over 30 and veterans. I am not the only one by which my peace has been breached by a staff, faculty and member of EDMC. I am a customer. I am responsible for thousands of dollars of revenue to this company that pay the salaries of men and women like Gerbson and Hoffman. Further, this is not the only incident leveled against Mr. Gerbson or Ms. Hoffman.

Given the facts of this case, I suggest to the Dean that he suspend any consideration of disciplinary action against me until my complaints against Hoffman and Gerbson have been addressed. For I am sure that the Dean would be very interested in the Department Chair's findings.

If the Dean were to find that I am at fault, I would like to specific advice on alternative courses of action when instructor 20 years your senior is yelling and threatening you at the top of his voice.

Dear James:

This letter is in regard to an alleged incident which occurred on April 27, 2011. Specifically, it was reported that you tampered with work that was being uploaded by a faculty member for a school project. Additionally, your behavior towards campus faculty was reported as rude, aggressive, and non-compliant. If found to be true, such behavior would be in violation of the following policies stated in the 2010-2011 Student Handbook:

6.b.ii. Breach of peace on college property or at any college-sponsored or supervised program.

14.a. Persistent or gross acts of willful disobedience or defiance toward college personnel.

14.b. Failure to comply with the direction of college officials, faculty, staff or security officers who are acting in performance of their duties.

15.e.vi. Use of computing facilities to interfere with the work of another student, faculty member, or school official.

I am aware of the grievance that you filed regarding this issue. Please be advised that David Schreiber will speak with you regarding this grievance after you make appointment with him at dschreiber@aii.edu.

As a result of the aforementioned allegations, you are required to meet with me no later than Friday, May 13, 2011 at 4PM, in order to discuss your involvement in this alleged incident. Failure to comply with this request will result in a decision being made without the benefit of your input. Any violations of the student conduct policy will be grounds for sanctioning and possible expulsion from The Art Institute. I can be reached at dkohn@aii.edu to schedule an appointment.
