HORRIBLE BOSSES - Bob Beach Part I: Sierra Army Depot Truth

Sierra Army Depot (SIAD) is a United States Army
post and ammunition storage facility located near the
unincorporated community of Herlong, California.


I got word that I got hired at Sierra Army Depot in June of last year.  But unlike my experience in the military, I found out the hard way that if the government makes a mistake its your fault and you pay for it.  I also found out what kind of man Bob Beach is - the man I would be working for.

$ 47,448 was one third of what I would usually make - quite a pay cut.  But I wanted to work and I loved working for the Army.  I spent most of my life's work there.  It would be good to be back doing something I knew and people who shared my commitment to the mission.

Then Darryl Kishbaugh called me to introduce himself and that he would be Sierra's liasion shepherding my employment transition.  The position did not require a security clearance but just a background check.

I know a lot of this seems trivial ticky-tack.  But if you want a job with the federal government, this is what you have to go through and this is how they treat you.

I discussed this issue with my Director, she is conferring with Mr. Marcotte and Mr. Beach, your future supervisor here at Sierra, concerning the findings of the local agency check performed here by Mr. Marcotte’s office.  I found that there is a Secret at OPM sitting there but we found the investigation number, this should be able to be resolved by Monday COB.  Please relax enjoy your weekend and I will contact your for sure Monday.

It demonstrates my attentiveness on this matter.  I understand that Mr. Marcotte is blocking and delaying my start date of July 29th as agreed.  He has had  2 months to air his concerns.  Every request for information, I have met and then some.  As Mssrs. Beach and Brittain have noted PCS is not authorized.  

It is coming out of my pocket.  Tomorrow is my last of work at my old job that I am leaving because I am taking the job at the Sierra Depot.  It is customary to give one's former employer 2 weeks notice.  Jobs in this economy are hard to come by.  Now Mr. Marcotte is pulling an 11th hour block on reasoning he will not share with me.  It is also worth noting that I turned down a similar job from Ms. Hudson so I could work with Mssrs. Beach and Brittain.  I have a secret clearance.
  
Mr. Marcotte has had 2 months. Mr. Marcotte doesn't know me and won't tell me what his concerns are. If he can't articulate his job in timely manner and is willing to damage the livelihood of a man he doesn't know, it speaks to his effectiveness.  I ask that you move forward with my July 29th start date as agreed.  Thank you for your attention.

Secondly, the problem was never following Mr. Kishbaugh's directions.   I have called him multiple times to get status updates.  I have met everyone of his suspenses.  I have provided him truth and direct answers to his questions.  Mr. Kishbaugh can attest to that.  

Third, Mr. Marcotte had two months to conduct his investigation and now at the last minute, he is resetting the clock with another NAC when Mr. Kishbaugh and Mr. Marcotte have confirmed I have a Secret Clearance and had one since May of this year.  And now Mr. Marcotte wants another SF-86?  This investigation will take months.   And none of the facts regarding my  background have changed.  What statutes, public policies or regulations sanction this decision making?

Lastly and most importantly, these decisions or indecisions have hurt me financially.  A written explanation is in order. Can you provide one?  If so, please do.  If not, why not?

On June 13, 2013, I accepted a tentative job offer from the Sierra CPAC from Steve Brittain.  Darryl Kishbaugh acted as my Human Resources Technician and Mr. Marcotte acted as the security manager.  On July 8th, Darryl Kishbaugh and I agreed on a start date of July 29, 2013.  Mr. Kishbaugh stated that I would be working for Robert Beach.   Then Mr. Kishbaugh tells me less than a week from my start date that Mr. Marcotte has security concerns about my honesty and that he needs time.  Then Mr. Kishbaugh tells me my local agency checks and my honesty are ok, but they they have to do another investigation saying that my investigation expired with a previous job offer.  But when I emailed the security office on the East Coast, they say it is not necessary.

The question I kept raising over and over with Mr. Kishbaugh, Brittain and Beach is that Mr. Marcotte had a month and a half to raise these objections and here he is delaying and blocking my start date at the last minute.  I want to know why?  I believe that something improper has happened and I want some accountability.  Can you help me?

Dear Mr. Bretney

It has determined that a waiver of fees is not appropriate for your request.  In determining a waiver of fees, we first determine if the records are in the public interest and would likely contribute significantly to public understanding of the operations or activities of the Department of Defense and second whether the information is primarily in the commercial interest of the requester.  The subject of your request is for your own records and your request states you are "requesting this information for personal use..."  the purpose of your request is not to inform the public but to investigate the financial damage Sierra CPAC may or may not have caused you.  The combination of these two factors clearly does not support the idea that furnishing the information is likely to contribute significantly to public understanding of the operations or activities of the Department of Defense because it is clearly about your financial records.  Under C6.1.4.3.1.3 of the FOIA you failed to explain how the disclosure of this information "will inform, or have the potential to inform the public, rather than simply the individual requester or small segment of interested persons."  To qualify as new media, you must provide information about your intentions of distributing the information so that this office can determine your "capability and intention to disseminate the information to the public."  For example, this office requires your qualifications, the nature of the research, the purpose of the requested information and the intended means of dissemination to the public.  Members of the news media qualify for a waiver of research costs and the first 100 pages, the remaining duplication cost still apply. 

In accordance with FOIA Regulation 5400.7-R you qualify as "All Other Requesters".  Section C6.1.5.8 requires "Requests from subjects about themselves will continue to be treated under the fee provisions of the Privacy Act of 1974 (reference (d)), which permit fees only for duplication costs.

Please let me know if you would like me to continue to process your requests.  If I do not hear from you by close of business 12 Aug 2013 I will consider your request administratively closed

I am disappointed by the lack of transparency and an unwillingness to provide information when there is evidence of dishonesty and incompetence.  You should reconsider your decision as there is a clear public interest:
ensuring public servants (i.e. Mr Marcotte of your organization) is acting in an honest, ethical and legal manner in the wake of the IRS scandals
the currency of security clearances, over-classication and privacy in the wake of the Snowden and Manning scandals

Nothing here was illegal and some would say unethical.  But I knew that Bob Beach didn't care about me.  If a person doesn't care about you, its hard to like or trust that person.  As a professional you tell yourself these things don't matter knowing that you tell yourself at your own peril.
