The Hatch Act states:
Regarding Social Media, the Hatch Act guidance issued throughout the Federal Government states:
- Engage in political activity while on duty, in a federal facility, wearing a uniform or official insignia, or using a federally-owned or leased vehicle, e.g:
- may not wear political buttons/T shirts/signs
- may not display/distribute campaign materials
- may not perform campaign-related chores
- may not make political contributions
- may not post a comment to a blog or social media site advocating for or against a partisan political party, candidate for partisan political office, or partisan political group
- may not use any email account or social media to distribute, send, or forward content that advocates for or against a partisan political party, candidate for partisan political office, or partisan political group
Federal employees retain the right to have and express personal opinions about candidates, elections and political parties outside of the workplace, using their personal computers, phones, etc. However, they need to have a heightened awareness of what they can and cannot post on a social media site. Employees using Facebook, Twitter, Linked In and other social media sites must be careful that they set and monitor their privacy and other social media settings so that postings to their sites do not link political commentary with their . . . title or position.
Merritt Shepard made six comments from TheGrio. According the wikipedia entry TheGrio is
is an American website with news and video content geared particularly toward African Americans. Originally launched in June 2009 as a division of NBC News, It became a division of the progressive-leaning MSNBC cable channel in 2013. It was founded by the team who created the documentary film Meeting David Wilson.Each time Shepard linked his inflammatory racist words to his official title on the Sierra Army Depot.

Merritt Shepard says he supports Equal Opportunity and does not discriminate in his professional life. Yet these statements and the statements that follow impeach his espousal.

These next four comments are problematic because he made them during the duty days. November 19, 2013 was a Monday. He may have made this comment from his smart phone on his lunch break. Was he on the Depot at the time of the comment? Why did he link his offense comments to his Federal Service in violation of the Hatch Act? He has states proudly he has worked been in federal service for over 30 years. Shouldn't he be held to a higher standard? Maybe he is completely incompetent or stupid. Then why is he a supervisor on the Depot?

CODE OF FEDERAL REGULATIONS PART 1400—STANDARDS OF CONDUCT, RESPONSIBILITIES, AND DISCIPLINE Subpart F—Disciplinary Actions and Penalties states
The Service shall take prompt disciplinary action against an employee committing prohibited activity, or whose conduct is prejudicial to the best interests of the Service, or of a nature to bring discredit to it. (§1400.735-60 )Certainly Merritt Shepard's Hatch Act violations bring discredit to the Service.

Sierra Army Depot has never investigated the incident. A supervisor on the depot has never been fired for mismanagement, fraud, theft or embezzlement.
