Imagine a World Without Islam

I am taking a graduate class in Byzantine History. I hate that class. It is so depressing. My teacher and my fellow students are wonderful. The subject matter is like watching drowning kittens. Here is midterm. I just hope I pass that class.

Starting with the Visigoths in the late 4th century A.D., we have read about various groups of ‘barbarians’ that had greater and lesser effects on the eastern or Byzantine Empire up to the 9th century. So far, which group do you think has had the greatest impact on the Empire and why?

The answer is obvious. The most important barbarian group that had the greatest impact on the Empire is the one that has the greatest impact on our Empire today - Islam and its adherents. Today, we have very few instances of non-Islamic Arabs or Persians, Goths, Franks, Bulgars or Slavs trying to commit mass murder against the Big or the Little Satan or its allies (the United States and Israel respectively).

What the world would look like if Constantine lived during the Mohammedan ecstasy. Would the world continue to regard the Arabian Peninsula as a "Felix Arabia" - a happy backwater rather than the home of a billion man suicide cult? What would the world look like if the Byzantines had acted like true Romans and wiped Islam off the map and plowed salt into Mecca and Medina? What would the world look like if the child-molesting prophet had been strangled in his crib?

The Byzantine Empire stands guilty of the vilest crimes of heresies and treachery. They accommodated the ugly threat to humanity that is Islam so they can stab their kinsmen in the back over the new novel heresy of the time - Aryanism, Monophysitism or the trouble with Icons. The Muslim is at the gate and these Greeks want to melt a portrait of Jesus, really?

History is replete with examples of how Latin rite Christianity would have reacted to the evil of Mohammedanism. Just take a walk down Tours, France, Google the year 1492 in Spanish history or recall these words uttered "Veni, Vidi, Dei Vici." History herself disabused the notion that the Byzantines provided a buffer state between the Infidels and us - instead the Byzantines were a human shield.

The Emperor Alexios I Komnenos tried to reverse near four centuries of tail tucking and skin saving. But his labors wielded half-hearted success because the laborer in the person of Alexios I Komnenos was at best a half-hearted man. To actually compare the Scythians, Visigoths, Ostrogoths, Vandals, Franks, Mongols, Huns or even the Zulus to the Satanic insanity that is Islam is really insulting ancient Barbarians. The Islamic civil war that gave birth to the Shiite and Sunni death cults gave the Byzantines evidence that Islam would not survive had they provided a unified front of self-preservation. Instead, Leo III the Isaurian started wars against his own people for reasons only he can justify - so much for unity.

In conclusion, we still live along Islam's bloody borders because the Byzantine legacy. Not only would our world be different, think if alongside the pedophiles and communists, how depopulated the infernal regions would be. Like I said, the answer is obvious.

Richard Bloom is the worst candidate among the pack. Santa Monica is a laughing stock about what not to do to spur economic growth. None of the commercial realtors I talked to advise going to Santa Monica. The only thing worse than your record as a job creator is a nuclear attack. Ask anyone trying to get a permit. No one can help you but they have 7 or 8 employees at a brand new office. There are parking meters all over Santa Monica and still Richard Bloom doesn't have enough money. The entire country is in an economic depression and Richard Bloom bans plastic bags? wtf America!

Let's not forget about that law enforcement record of Richard Bloom. Richard Bloom imports poor people to place in rent controlled housing so he can buy votes, yet law abiding working citizens can't rent in Santa Monica. The vagrancy in Santa Monica is the worst among the beach cities save Venice Beach and yet who does misdemeanor city attorney Terry White prosecute? LAW ABIDING CITIZENS. Terry White's no mercy, no compassion, no common sense approach to prosecution criminalizes the poor, working and the suffering while vagrants and crooks get kid gloves treatment. Terry White prosecuted law abiding citizens for offenses like criminal noise complaint, blocking an entrance, camping and public urination (there are no public restrooms in Santa Monica - not even in fast food restaurants.)

1) Further, according to Dawn Kohn’s affidavit I“revealed” to McLaren that I “wanted to pull a Jared Loughner.” She “took this to mean that” I “wantedto come in and shoot and kill people on campus.”

2) McLaren also alleged in Kohn’s affidavit that Irecently purchased a handgun in Arizona.

3) McLaren also alleged in Kohn’s affidavit that Irecently stopped taking anti-psychotic medication.

All these statements are false. Andrew McLaren, Aaron Morris, EmalSekandari, John Spears, Dawn Kohn, Aaron Pompey and Laura Soloff know them tobe false.

Santa Monica Police Department investigated thematter at the request of Kohn, Pompey and Soloff. They did not find any evidence of a conspiracy to commit anact of domestic terrorism. Theydid not find a gun purchase made in my name in the firearms database. Further I had revealed to all partiesconcerned that I stopped taking Xanax and Zoloft five years ago. Xanax and Zoloft are anti-depressantmedications not anti-psychotic medication as Ms. Kohn alleged.

Further my roommate Daniel Thompson spoke withSanta Monica Police, Aaron Pompey and Laura Soloff and he verified that I aminnocent of any plot or conspiracy to commit violence against the school.

Further Andrew McLaren, Aaron Morris, EmalSekandari, John Spears, Dawn Kohn, Aaron Pompey and Laura Soloff know thatsince the Kohn-Pompey suspended me on May 14, 2011. My last email to Aaron Pompey protesting his decline of myappeal was sent on June 14, 2011. Laura Soloff is a known associate of Andrew McLaren, anarmed and dangerous gunrunner who wishes me dead. She herself made a death threat against me by proxy. She knowingly propagates publicinformation to me that is false and communicates to me by messenger. I ask the court to restrain her frommaking public statements about me that are false and stop having her agents andemployees from harassing and annoying me online.

Laura Soloff is the President of the Art Institute ofCalifornia, a business I patronized for 2 years.

In May of 2011, we terminated our business relationship towhich I publicized my dissatisfaction with the business practices she employsVeteran, gender, age and disability discrimination, slander and general abuse.

In August of 2011, Laura Soloff made common cause withAndrew McLaren, a violent mercenary and ex-Iraq War veteran. McLaren fabricated a plot to commit anact of domestic terrorism. Santa Monica police detective Eddie Soto filed an incident report11-80366 and concluded there was no crime.

At first I laughed at these accusations as preposterous anddid my best to move on with my life.

Soloff sent emails to a distribution list of over 2,000recipients accusing me of being a terrorist and conspirator to commit murder. I get messages from her messengersstating that 3 police cars with sirens blaring and pistols drawn storming theArt Institute in search of me trying to kill me or hurt me even though I havecommitted no crime.

She employed a law firm, Snell and Wilmer LLP of 600 AntonBoulevard Suite 1400, Costa Mesa California 92663 to conduct an investigationagainst me by interviewing several of my friends and associates. Everyone interviewed verified DetectiveEddie Soto’s conclusion that there was no crime.

Yet Soloff had her lawyers knowingly withhold that evidencein seeking a protective order against me. On August 24, 2011, Judge Coral Boas Goodson issued a protective orderagainst me as I was stuck in traffic on the date of the hearing. This protective order defrauds me fromcompleting my education with the Art Institute, as I was two quarters away fromgraduating. It defrauds me fromusing their career center. Itdefrauds me from sitting in classes I previously attended. It impedes any attempt to further mymentor relationships with staff and instructors friendly to me. One of my instructors, a currentproduction executive at Sony Pictures sincerely favored me. Soloff and McLaren’s fraudulent protective order was meant todestroy that relationship.

It impedes collaboration I make with friends I made amongthe current student body of the Art Institute of California. This was by design and not to mitigate any security threat.

Soloff encourages Andrew McLaren and his politicaloperatives: John Sears, Emal Sekandari, Aaron Morris and others to annoy,harass and make online death threats against me.

On September 18, 2011, Soloff-McLaren commented on one of myYouTube videos “Chazz Bono ranting.” This comment made by agents of Soloff and McLaren communicates theirintent to harass, annoy and intimidate me. This comment made by agents of Soloff and McLaren violatethe temporary restraining order issued by Judge Cowan ordered on September 13,2011.

In the national news, Santa Monica Police stormed the campusof Santa Monica College due to a credible bomb threat. In addition, Soloff employs an armedsecurity detail. Thisplain-clothes detail patrols a perimeter beyond the property of the ArtInstitute. Her messengers told methat the Art Institute has received an increased number of death and bombthreats. Soloff reports thesedeath threats and bomb threats to the police and the general public. Soloff attributes them to me though Ihave nothing to do with them.

Prior to this affair, I considered Laura Soloff a friend. Isaw the dissolution of our business relationship a misunderstanding due to theirresponsibility of two rogue employees.

Her decision to make common cause with Andrew McLaren andhis associates forced me to reconsider this posture of friendship. Andrew McLaren and his men committedthemselves to a campaign of intimidation, harassment, wishing to do harmagainst me, and wishing my death. Soloff acquiesces to this evil design and stands most to profit from it. Goldman Sachs, a company held in illrepute by the general public owns the Art Institutes. There is a class action lawsuit against the Art Institutesfiled by former students. AlsoDepartment of Justice is probing the Art Institutes for allegations offinancial aid fraud. My deathwould silence my accusations of discrimination, slander and general abuseagainst her and her company.

On September 19, 2011, I met with Detective Eddie Soto’s supervisor,as Detective Soto was unavailable. I related to Detective Eddie Soto’s supervisor that I would cooperatewith Detective Soto’s investigation, that I am not now nor have I in the past desirefor violence against the Art Institute of California or any of its current,past or future students, employees or associates. I also communicated my fear that Soloff and McLaren areconspiring to re-create a death by cop situation.

Soloff and McLaren’s campaign of harassment and intimidationcause me and my family to loose sleep and inflict emotional and personaldistress.

If anything bespeaking of foul play or untoward shouldhappen to me, let it not be said that I failed to inform the authorities. I ask the court to issue a restrainingorder against Laura Soloff.

1. I am a man over the age of 18. I was a customer of the Art Instituteof California-Los Angeles, Inc. (“Art Institute”). Unlessotherwise indicated, I state the following to be true.

2. I respectfully request the court restrain AaronPompey, an employee of the Art Institute. He committed a series of acts that has alarmed me and caused me tobelieve that I am under a threat of serious bodily injury from her. I fear that He will inflict injury onme at my work place and home, 1421 West Venice Boulevard # 7, Venice,California 90291.

3. I am pursuing legal defense of my reputation andlegal recovery of damages inflicted against me by the Art Institute.

4. I was a customer the Art Institute from Augustof 2009 to May of 2011. I heard many complaints by fellow students about hisbehavior as the ‘Dean of Students.’ These complaints include him to being rude to students, heartless, dishonest,falsifying and knowingly distorting and excluding material facts on officialreports.

5. Aaron Pompey supervises Dawn Kohn, mentallyimbalanced. Woman who frequently ignores student complaints about the ArtInstitute. Instead he twisted thesecomplaints in official documents.

6. One such complaint dated January 25, 2011concerned an Art Institute employee who arbitrarily denied service where it washis job to do so. Instead, Ms.Kohn held a conduct hearing against me. Mr. Pompey supervised this ‘hearing’ and approved it.

7. On February 4, 2011, the Department Chairman hada misunderstanding with me that got heated. We later apologized and resolved the matter betweenourselves. Ms. Kohn insinuatedherself in the disagreement and trumped up another conduct hearing against me.Mr. Pompey supervised this ‘hearing’ and approved it.

8. On April 27, 2011, an instructor invaded astudio I reserved to do my lighting homework work using moving camera andperformers. This instructor triedto provoke a fight with me. Ispoken with the instructor’s boss and he apologized for the instructor. Ms.Kohn insinuated herself again where I attended yet another one of her conducthearings. He was rude, aggressiveand non-compliant. He interruptedme when I was speaking. He triedto get me to answer her questions with answers He wanted me to say. I found the incident absurd, ended themeeting and demanded to speak with her supervisor, Aaron Pompey. Aaron Pompeysaid he would speak to me after I made an appointment. Later, he refused to meet with me.

9. He asked that I no longer attend the ArtInstitute for a year. I agreed. Iposted on my blog www.theundiscoveredcountry.blogspot.commy complaints of harassment and Veteran’s discrimination by the Art Institute.On June 14, 2011, I terminated my business relationship with the Art Institute.I wanted to get on with the rest of my life.

On or about July 24, 2011, I received harassingcomments and death threats on my online social media from the accounts“LuckOfTheDraw” and “ACTORWRITER.” These comments came after I posted a video criticizing those who areunsympathetic and insensitive to Veterans. The video I posted on youtube did not name the Art Instituteor any of its employees.

11. On Monday, August 1, 2011, I received a phonecall from a man claiming to be Detective Eddie Soto from the Santa MonicaPolice Department. This caller didnot have any credentials verifying that he was a police officer. This caller asked me to incriminatemyself in an act of domestic terrorism. I spoke to this “caller” for ten minutes. I protested his lack of discretion, hisattempt to usurp my Constitutional rights, and the fact that he was respondingto a call with nothing to go on except hearsay evidence. I really questioned whether or not thiscaller was a policeman, as he hung up me. I can only speculate that this caller was unsatisfied with my answers.

12. On August 24, 2011, Dawn Kohn received a restrainingorder from the court alleging harassment. Aaron Pompey attached himself to thisrestraining order. I had noopportunity to defend myself from this claim.

13. In a declaration to the court, his subordinateDawn Kohn alleged that she received independent, anonymous phone calls from a‘gentleman’ named ‘Andrew.’ Welater identified this Andrew as Andrew McLaren – a disgruntled employee Idischarged July 12, 2010.

14. Andrew McLaren makes a living as amercenary. One job he took, hemade sure a shipment of guns arrived to Iran. He is a various dangerous man with run-ins with thelaw. He sent me 22 unsolicitedtext messages calling me a gutless bastard, backstabber, user, fake friend andthat my mother and father are bad parents. He said in his text messages that he is ‘too classy’ to dealwith me directly that he has his agents John Spears (LuckOfTheDraw) and EmalSekandari (ACTORWRITER) harass me and threaten my life online. He has had his Press Agent AmandaMitchell, his lawyer and his manager Aaron Morris contact me on his behalf eventhough he knows I have no desire to talk with him.

15. According to Dawn Kohn’s declaration that Mr.Pompey consented to, Andrew McLaren said that I am an Iraq War Veteransuffering from Post Traumatic Stress Disorders. I stopped taking my “anti-psychotic medication.” I purchased a handgun in Arizona withthe intent to “pull a Jared Loughner at AI.” These statements are false. Ms. Kohn and Mr. Pompey knew them to be false and declaredthem with an intent to mislead.

16. Mr. Pompey knew I was an Iraq War Veteran andthat I suffer from Post Traumatic Stress Disorder because I volunteered thatinformation in my complaints to her at the Art Institute in my discriminationcomplaints and requests for accommodation afforded to me by the law.

17. Mr. Pompey characterized commonly prescribedanti-depressant medication as anti-psychotic and that Andrew McLaren recentlymade her aware of this. This toois a false statement with an intent to deceive as I volunteered to herconference regarding my in my discrimination complaints and requests foraccommodation afforded to me by the law. Further, I mentioned to him I stopped taking those medications 5 yearsago in 2006.

18. Mr. Pompey mentioned that I had recentlypurchase a handgun in Arizona. Aninvestigation conducted by Art Institute’s very own lawyers, Snell &Wilmer, interviewed friends and associates of mine at the Art Institute showedthat I sold my handgun in March.

19. The investigation conducted by the ArtInstitute’s own law firm, Snell & Wilmer, failed to uncover any lone wolfschool shooting plots against the Art Institute perpetrated by me. Snell & Wilmer interviewed myroommate over the course of an hour and could find no evidence of any crime.

20. Not did Pompey withhold exculpatory evidence atthis restraining order trial, He embellished perjured testimony on her August24, 2011 court appearance.

21. Since that time, Pompey still makes publicstatements about me that are false. He sends over 2,000 emails. He sends messages to me via messengeraccusing me of making bomb threats or calls to the police department where 3cars of police stormed with guns drawn the Art Institute looking for me eventhough I have not come within 100 feet of the Art Institute since May of2011. The Art Institute at thedirector of Ms. Kohn and her supervisor Mr. Pompey have posted plain clothessecurity details beyond the 100 yard distance of the Art Institute prescribedby law. He and Andrew McLarenstill send harassing comments on my social media wishing I was dead or that Iam a disgrace to all veterans and that my parents are ashamed of me.

22. I have tried my best to move on with my life andignore this. But the harassmentthat Pompey-Kohn-McLaren have colluded has affected my sleep, my work and myreputation. My family has sufferedadversely which has caused me to feel greater pain. I am respectfully request the court restrain this man and hisagents from harassing me. Thankyou

1. I am a man over the age of 18. I was a customer of the Art Instituteof California-Los Angeles, Inc. (“Art Institute”). Unlessotherwise indicated, I state the following to be true.

2. I respectfully request the court restrain DawnKohn, an employee of the Art Institute. She committed a series of acts that has alarmed me and caused me tobelieve that I am under a threat of serious bodily injury from her. I fear that she will inflict injury onme at my work place and home, 1421 West Venice Boulevard # 7, Venice,California 90291.

3. I am pursuing legal defense of my reputation andlegal recovery of damages inflicted against me by the Art Institute.

4. I was a customer the Art Institute from Augustof 2009 to May of 2011. I heard many complaints by fellow students about herbehavior as the ‘Director of Student Development.’ These complaints include her to being rude to students,disruptive, insubordination, screaming at students, falsifying and knowinglydistorting and excluding material facts on official reports.

5. Many students including myself believe her to bementally imbalanced. She frequently ignored student complaints that myself andfellow students made about the Art Institute. Instead she would twist these complaints against us inofficial documents.

6. One such complaint dated January 25, 2011 concernedan Art Institute employee arbitrarily denied service where it was his job to doso. Instead, Ms. Kohn held aconduct hearing against me.

8. On April 27, 2011, an instructor invaded astudio I reserved to do my lighting homework work using moving camera andperformers. This instructor triedto provoke a fight with me. Ispoken with the instructor’s boss and he apologized for the instructor. Ms.Kohn insinuated herself again where I attended yet another one of her conducthearings. She was rude, aggressiveand non-compliant. She interruptedme when I was speaking. She triedto get me to answer her questions with answers she wanted me to say. I found the incident absurd, ended themeeting and demanded to speak with her supervisor, which she thwarted.

9. She asked that I no longer attend the ArtInstitute for a year. I agreed. Iposted on my blog www.theundiscoveredcountry.blogspot.commy complaints of harassment and Veteran’s discrimination by the Art Institute.On June 14, 2011, I terminated my business relationship with the Art Institute.I wanted to get on with the rest of my life.

Dear Sirs,

I was watching a video on youtube by which I had to watch your ad to get to the video I wanted to watch. The ad in question was entitled Confession.

The hero in the ad went to confession to confess he is a fornicator, by which the Priest asked his name and who did he sin with. He then lists all the loose women in the town to imply with ambiguity that perhaps he as fornicated with these women as well. The hero walks way saying "I got two more leads."

This is offensive to Catholics in the following ways:

1) the hero makes no sincere attempt to repent from the sin and avoid near occasions of sin. The whole point of going to confession is free oneself from the slavery of sin and to re-unite with God by which we enjoy perfect freedom. What is the point of going to confession we enjoy the sin and don't see it as harmful?

2) the hero doesn't value confession or Catholicism. He enjoys fornication. Fornication is a serious sin. It devalues both man and woman. The knowledge of fornication devalues others who do not participate in it. It separates us from God as God calls us to live in chastity as single persons and in monogamy in marriage. That is what we believe. If you do not want us as customers, do not mock our beliefs.

3) the commercial mocks the authority of the Church. The Priest is the authority. You dress him the traditional pre-Vatican 2 Cossack and his dialogue is about an irrelevant inquiry about the identity of the loose woman in question. Now sirs, I have been going to confession all my life. I am 38. I made my first confession when I was 8. At no time, did my priest ask me the identities of those with whom I was offending God with. Why is this Priest asking the identity of this loose woman? Also the hero does not tell the Priest the identity of the woman so in not doing as the Priest asked, he flouts the authority of the Priest.

Look, if you don't want Catholics to drink Red Bull, no harm no foul. I will go my way and you go yours. But I got to tell you, I won't be patronizing your product and I will encourage others to try other products. I do not and I encourage others not to drink Pepsi because they use aborted fetus in their taste testing, I could easily put your product next to Pepsi on my do not buy list. Just as Pepsi has Coke, you have Monster and Five Hour Energy Drink. I have drank Red Bull in the past and will continue to do so but not in light of your decision to air this ad. I encourage its repeal. Thank you.

2012 - GOP Landslide?

In my previous blog, I outlined Barack Obama most probablepath to victory. It contains theimprimatur of the mainstream pundits. Conventional wisdom not only lacks novelty, it often lacksaccuracy. None of the conventionalwisdom pundits predicted the housing bubble of 2008. The conventional wisdom failed to predict any of theeconomic calamities since the tower of Babel. The conventional wisdom did not predict the 80-seat pick upby the Tea Party. Thus we mustcast aside beliefs and agreed upon truths held by the majority and we mustthink outside the box. Wecalibrate our creativity against the cold hard facts. But to be creative we have to do something that we encouragein children and discourage in adults.

We have to dream.

The support for this President oscillates between tepid andrage. Let’s face it, he is at besta disappointment and at worst a disgrace. And if more Americans we agree me, and every passing day they do, thereis only one way to deal with those who have disgraced us – permanent dismissal.

If the Republican challenger garners all the 179 electoralvotes from the 22 McCain states and the 110 electoral votes from all nine of theswing states (Ohio, Indiana, NewHampshire, Florida, North Carolina, Virginia, Colorado, Nevada, New Mexico), hewill have 289 electoral votes. This means he will have 19 more electoral votes more than the 270 neededto win.

But what if he could win 365? What if this new leader could command the same number ofvotes that Barack Obama himself commanded in 2008? He will have a mandate will he not? He most assuredly will havesupermajorities in the House and Senate. He will have a mandate to govern.

Is it even possible?

Not only is possible, the likelihood grows everyday. Consider the following states that thisbold challenger could win:

The economy in these states isn’timproving and they know it. Theright Republican challenger – a tactful charismatic conservative could findlegions of 21^st century Reagan democrats – re-flagged once asso-called ‘independents’ - flocking to his banner.

An Obama Squeaker - Obama's Best Chance at Re-Election

Obama concedes that he cannot replicate his spectacularsuccess of the 2008 campaign. Inthat campaign Barack Obama decisively got 10 million more Americans to vote forhim over his opponent. He carried28 states – six more than his opponent and won 365 electoral votes. He won 95 more electoral votes than the270 votes to win. Clearly hiscampaign optimized the mood of the country and through his rhetoric shaped it.

The biggest hurdle that Obama must overcome is hisrecord. If the President had arecord, he could be proud of he could capitalize on his gains. He could hold the states he won in 2008and pick up more states much like Ronald Reagan did in 1984. That 50 state campaign strategy is nowa fantasy. Ever since the 2010Congressional elections, where the Tea Party picked up more than 80 seats inthe House and 3 shy of controlling the Senate, the repudiation of the Obama mandatehas humbled even the proudest zealots within his administration.

Obama is on defense.

But Obama’s defensive position looks very good. To win again, he would need to retainall the states that Vice President Al Gore retained in the 2000 election plustwo or three battleground states. Those states are:

Obama has an abysmal economic track record and saggingpopularity numbers. His jobapproval numbers hit 38% for the first time in his Presidency. Only Jimmy Carter was lower at 31% atthis point in his President. Whena President is below 50%, his re-election chances statistically andhistorically are against him. ButPresident Obama has the power of incumbency. He also has an enormous fundraising war chest. He will have plenty of money toenergize his base and disparage his opponent in a weak attempt to persuade theAmerican people to give him another chance.

MEMORANDUMOF LAW IN SUPPORT OF MOTIONS TO DISMISS

DefendantJames Anthony Bretney submits this Memorandum of Law in support of hispending motion to dismiss on the ground that pursuant to California Penal Code995.

Summary of Grounds for Motions.

Even if everything the prosecutionalleges is true, the conversation in question was not a confidentialcommunication.

The defendant depressed a buttonthat activated the speakerphone option on his cellular phone. Detective Eddie Soto knew that thespeakerphone option had been activated when the defendant asked Detective Sototo “hold on.” Detective Soto consented to others listening in on this conversationtherefore it is not a confidential communication.

The suspect has a right to privacyand therefore his communications are confidential. This is also true for complainants, witnesses and privatepersons. The defendant at the timewas a suspect in case involving conspiracy to commit premeditated murder,assault and an act of terrorism.

No conversation with a policeofficer in the course of his public duties is confidential. A police officer is apublic servant. A policeofficer works for the public. Heis in the pay of the public. Hiswork is the public business. Herecords everything he does everyday he is on the clock in police, crime andincident reports. These reportsare in the public domain and the public has a right to view them. Dash camerasrecord the actions of police officers. The officers wear digital audio recording devices to record theirconversations. The state cannotassert a privacy right afforded to public officers involved in public business.

The word of a police officer alwaysrates higher than a law abiding citizen in a court of law despite policepromises that they are here to protect and serve the public. A police officer, assuming he is areasonable person with average intelligence, must expect in the light of theRodney King taping, the taping of the death of Kelly Thomas, and the policekilling of Long Beach resident Douglas Zerby that the citizens will tape andrecord him.

Current case law substantiates thisview. Rogers v. Ulrich , 52 Cal.App.3d 894 held that "But appellant [Rogers] has not shown how hecould allege that a communication with a public employee [Ulrich], concerningpublic business such as the use of the council chambers for a meeting, could be[52 Cal.App.3d 900] confidential within the meaning of the statute." The Rogers case clearly vindicates thedefendant as it concerns a communication with a public employee concerningpublic business is not confidential.

No conversation with a policeofficer in the course of his public duties where the other party is a suspectis confidential.

Deteresa v. ABC (121 F.3d 460) inquoting the statute “in any other circumstance in which the parties to thecommunication may reasonably expect that the communication may be overheard orrecorded.” Detective Eddie Sotostated that the he would record the defendant’s responses in his report in thatcircumstance the communication was not confidential.

Further, Deteresa states “neither party reasonably expects thecommunication to be confined to the parties, it is not confidential.” Therefore Detective Soto’scommunication with the defendant is not confidential.

According to the Miranda warningthat Detective Soto did not read to the defendant, the defendant has a ”rightto remain silent. Anything [he might say] or do can and will be held against[him] in a court of law.” Detective Eddie Soto initiated the call, identified himself that he wasa Santa Monica Policeman and that it was not a joke or crank call. He said whatever I say to him will goin his report.

If we were to apply the DeTeresacase further we would find: “wemust ask whether [Officer Eddie Soto] had an objectively reasonable expectationthat the conversation would not be divulged to anyone else. [Bretney] contends that there is no triable issue as to the fact that [OfficerEddie Soto] had no such expectation-[Soto] immediately revealed that he workedfor the [Santa Monica Police Department] and wanted [Bretney] to discuss [theaccusations of conspiracy to commit premeditated murder, assault and an act ofterrorism; Officer Eddie Soto] did not tell [Bretney] that[his] statements were in confidence; [Officer Eddie Soto] did nottell [Bretney] that the conversation was just between them; and[Officer Eddie Soto] did not request that [Bretney] not share the informationwith anyone else. . . . that noone in [Detective Eddie Soto]'s shoes could reasonably expect that a PoliceOfficer would not divulge Bretney’s responses as to the accusations ofconspiracy to commit premeditated murder, assault and an act of terrorism.

If Penal Code, section 633 exemptslaw enforcement officers from the operation of section 632 to the extent thatthey could lawfully overhear conversation prior to the enactment of section632, a reasonable person of average intelligence may reasonably expect that thecommunication may be overheard or recorded. Therefore the communication is not confidential. (People v.Blair (1969) 2 Cal. App. 3d 249 [82 Cal.Rptr. 673] )

A "man detained in jail cannot reasonably expect to enjoythe privacy afforded to a person in free society. His lack of privacy is anecessary adjunct to his imprisonment." (People v. Morgan, 197 Cal. App.2d 90, 93 [16 Cal.Rptr. 838] [cert. den. 370 U.S. 965 [8 L.Ed.2d 830, 82 S.Ct.1606]]; People v. Lopez, 60 Cal. 2d 223, 248 [32 Cal.Rptr. 424, 384 P.2d 16];People v. Chandler, 262 Cal. App. 2d 350, 355 [68 Cal.Rptr. 645]; Lanza v. NewYork, 370 U.S. 139, 143 [8 L.Ed.2d 384, 387, 82 S.Ct. 1218].) A conversation, even a telephonicconversation where the police officer initiated the phone call and is engagingin a type of fishing expedition and soliciting the suspect to incriminate himselfis a kind of detention. Therefore the communication is not confidential. (People v. Blair (1969)2 Cal. App. 3d 249 [82 Cal.Rptr. 673] )

The Plaintiff claims a violation ofhis constitutional right of privacy in the recording of the conversation inquestion. It is now settled law that detainee, an inmate of a jail or prisonmay not successfully complain of such a recording even if its taking was notknown to him at the time.

In People v. Miller, 252 Cal. App.2d 877, 881 (fn. 2) [60 Cal.Rptr. 791] we said: "It is well established,moreover, 'that a jail shares none of the attributes of privacy of a home, anautomobile, an office or a hotel room' (Lanza v. New York, 370 U.S. 139, 143 [8L.Ed.2d 384, 387, 82 S.Ct. 1218]); that inmates of prisons do not have theusual array of federal and state constitutional [262 Cal. App. 2d 356] rightsguaranteed to nonincarcerated citizens. (Price v. Johnston, 334 U.S. 266, 285[92 L.Ed. 1356, 1369, 68 S.Ct. 1049];

If "In re Ferguson, 55 Cal. 2d663, 670-671 [12 Cal.Rptr. 753, 361 P.2d 417]; Davis v. Superior Court, 175Cal. App. 2d 8, 20 [345 P.2d 513]; People v. Hernandez, 229 Cal. App. 2d 143,149 [40 Cal.Rptr. 100]); and that prison authorities may subject inmates tointense surveillance and search unimpeded by Fourth Amendment barriers. (Lanzav. New York, supra; People v. Hernandez, supra.).

In People v. Morgan, 197 Cal. App.2d 90, 92-94 [16 Cal.Rptr. 838] (cert. den. 370 U.S. 965 [8 L.Ed.2d 830, 82 S.Ct.1606]) it was held that an electronic recording of conversation between acounty jail prisoner and his sister was not an illegal search and seizure noran unlawful invasion of the prisoner's privacy. The court stated as follows: 'Aman detained in jail cannot reasonably expect to enjoy the privacy afforded toa person in free society. His lack of privacy is a necessary adjunct to hisimprisonment.' (P. 93.)

In People v. Lopez, 60 Cal. 2d 223,248 [32 Cal.Rptr. 424, 384 P.2d 16], it was held that 'Except only insofar asconcerns consultation with his attorney in a room designated for that purpose,a prisoner has no right of privacy in a jail.' " (See also People v.Apodaca, 252 Cal. App. 2d 656, 658-659 [60 Cal.Rptr. 782].) Reasonably theright of defendant to privacy while under valid arrest in a police car can beno greater than if he were confined in jail.

A reasonable person of averageintelligence would presume that solicitous conversations of an incriminating naturewith the police where the person in question is a suspect would be recorded andtherefore not confidential communications.

No conversation with a policeofficer in the course of his public duties where the other party is a suspectand the alleged crime is conspiracy to commit an act of terrorism orpremeditated murder or assault (the threat of violence.) By the Deteresa reasoning, the topic ofa conspiracy to commit an infamous act of mass murder on the scale of theVirginia Tech shooting, the Oklahoma City bombing or the Olso shooting is notconfidential. In August 16 of thisyear, a report of unconfirmed gunman on the Santa Monica College campus madenational headlines.

The conversation was notconfidential as the defendant had a reasonable expectation that the other partyrecorded the conversation.

At the time of the call, thedefendant had no independent verification of the caller’s policecredentials. Therefore thedefendant had a reasonable expectation that conversation was recorded and notconfidential. The caller was apolice officer. The caller toldthe defendant that this conversation was to be recorded in the caller’sincident report. Also policeofficers record their conversations on an audio digital recording device.

At the time of the call, thedefendant had no independent verification of the caller’s policecredentials. Therefore thedefendant had a reasonable expectation that conversation was recorded and notconfidential. Thedefendant could reasonable expect that the phone call in question was a crank or joke call.

The conversation was notconfidential as the defendant had a reasonable expectation that the other partyrecorded the conversation. People v. Blair (1969) 2 Cal. App. 3d 249 [82 Cal.Rptr. 673] , People v.Lopez, 60 Cal. 2d 223, 248 [32 Cal.Rptr. 424, 384 P.2d 16], People v. Morgan,197 Cal. App. 2d 90, 92-94 [16 Cal.Rptr. 838] (cert. den. 370 U.S. 965 [8L.Ed.2d 830, 82 S.Ct. 1606]), Davis v. Superior Court, 175 Cal. App. 2d 8, 20[345 P.2d 513]; People v. Hernandez, 229 Cal. App. 2d 143, 149 [40 Cal.Rptr.100], People v. Miller [252 Cal. App. 2d 877], People v. Chandler [262 Cal.App. 2d 350] are cases upholding the convictions of those held in policecustody based on a recording by the police without informing the defendant ofthe recording device.

In Warden v. Kahn (1979) 99 Cal.App.3d805 , 160 Cal.Rptr. 471, the court stated “We are mindful of the generalprinciple that in a criminal prosecution the defendant should be given thebenefit of doubt as between two plausible interpretations of a penal statute.(E.g., People v. Ralph, supra, 24 Cal.2d at p. 581.

O'Laskey v. Sortino(1990) 224Cal.App.3d 241 , 273 Cal.Rptr. 674 stated when communications may beconfidential: “an expectation ofprivacy is objectively reasonable in telephone conversations between businessassociates relating to ongoing ventures (Frio v. Superior Court (1988) 203Cal.App.3d 1480, 1488-1490 [250 Cal.Rptr. 819]), between an attorney and aphysician who had previously refused to assist the attorney in a personalinjury case (People v. Wyrick, supra, 77 Cal.App.3d 903, 909), and probablybetween an attorney and a blind client notwithstanding the client's belief thata reasonable attorney would expect his telephone conversations with a blindclient to be recorded (Warden v. Kahn (1979) 99 Cal.App.3d 805, 814-815 [160 Cal.Rptr.471]). . . . The investigator wasa complete stranger to [the defendant] . . . In short, judged objectively, there was no reasonableexpectation of [224 Cal.App.3d 249] confidentiality and nothing to indicate adesire by [Detetcive Eddie Soto] that the communication be confined to theparties thereto.

The purpose of this letter is to complain about the ethicalconduct of the following lawyers:

In the summer of 2011, Bennett and Denniston took on a casefrom a corporate client, the Art Institute of California in Los Angeles, asubsidiary of the Education Management Corporation (EDMC). EDMC is 41% owned by Goldman Sachs.

Bennett and Denniston represented the Art Institute inobtaining a restraining order against a former student whom theysuspended. The terms of thesuspension required that this former student stay away from the Art Institutefor one year.

Bennett and Denniston obtained their restraining orderagainst this former student by:

(1) Improperlyserving their defendant

(2) Useof perjured testimony

(3) Withholdingexculpatory evidence against the defendant

(4) Embellishingexisting testimony hostile to the facts of the case

The conduct of Bennett and Denniston during the trial of ArtInstitute of California in Los Angeles versus James Anthony Bretneyviolated Rule 5-200 prescribing Trial Conduct. Rule 5-200 Trial Conduct states a member of the state bar ofCalifornia shall:

(A) Shallemploy . . . means consistent with the truth

(B) Shallnot seek to mislead the judge, judicial officer, or jury by an artifice orfalse statement of fact or law

Bennett and Denniston on behalf of the Art Institute soughtand obtained a restraining order using the petition for Orders to StopWorkplace Violence, WV-100. Yetpage 5 of the petition authorized by Judge Carol Goodson requires “at leastfive days before the hearing.” Noone served me personally. Myroommate found the summons on my door less than five days before the hearing.

Bennett and Denniston on behalf of the Art Institute basedtheir case on the perjured testimony of Andrew McLaren. Andrew McLaren makes his living as areality TV actor and a mercenary. One job he took smuggled guns into Iran, a state sponsor of terrorism inviolation of U.S. and international law.

Bennett and Denniston on behalf of the Art Institute, intheir August 8, 2011 filing for a Temporary Restraining Order claimed to thatDawn Kohn, an employee of the Art Institute received “independent” phone callsfrom an “anonymous” caller, a “gentleman” named “Andrew.” This was a false statement and the allparties knew it to be false. Detective Eddie Soto of the Santa Monica Police Department interviewedmyself and my roommate on August 1, 2011 when this anonymous, independentgentlemen caller named Andrew called Dawn Kohn. Detective Soto identified this anonymous, independentgentleman caller named Andrew as Andrew McLaren. My roommate provided Detective Soto with Andrew McLaren’sphone number. McLaren laterconfessed that these anonymous, independent gentlemen calls came from him. Yet Bennett and Denniston deliberatelymislead Judge Goodson to award Art Institute the restraining order.

Bennett and Denniston on behalf of the Art Institute, intheir August 8, 2011 filing for a Temporary Restraining Order asked the courtto forbid the use of “hearsay”evidence yet they included the perjured McLaren testimony which is nothing but“hearsay” evidence.

Bennett and Denniston on behalf of the Art Institute knewMcLaren was lying and encouraged him to perjure himself. Bennett and Denniston conductedinterviews with friends and associates of the defendant as many were stillstudent of the Art Institute. Noneof those interviews validated McLaren’s false accusations.

McLaren claimed that the defendant confided a plot to shootup the school and “pull a Jared Loughner.” Yet interviews conducted by the police, the Art Instituteand Bennett and Denniston could not substantiate McLaren’s allegation. Did McLaren enjoy a special intimacywith the defendant that excluded his other friends and associates? Even if Bennett and Dennistonassume that McLaren enjoyed a special intimacy when did such an intimacy takeplace?

Bennett and Denniston knew by interviews with McLaren, thedefendant’s friends and associates, the Art Institute and the Santa MonicaPolice that the last telephonic conversation occurred July 12, 2011. The defendant and McLaren saweach other in February of 2011, where the defendant kicked McLaren out of hishome as he was staying on the defendant’s couch and again mid-April of2011. Further Bennett andDenniston cannot produce McLaren’s email, text message or postal correspondencewith the defendant corroborating McLaren’s allegation because they suchevidence did not exist.

Bennett and Denniston knew McLaren was lying.

Bennett and Denniston knew the defendant and McLaren werebusiness partners, the partnership dissolved and that McLaren wasretaliating. Bennett and Dennistoncite the defendant’s social media on blogger, facebook and youtube as evidenceagainst the defendant. Bennett and Denniston volunteered the defendant’s socialmedia to the Santa Monica Police Department.

Yet Bennett and Denniston ignored McLaren’s harassingcomments and death threats against the defendant. On the defendant’s youtube channel, McLaren’sco-conspirators John Spears, posting under the handle “LuckoftheDraw” and EmalSekandari posting under the handle “ACTORWRITER” harass the defendantonline. “LuckoftheDraw”posted a comment wishing the defendant would kill himself. “LuckoftheDraw”later deleted the comment and backpedaled from making the threat. If the defendant did commitsuicide, the defendant’s death would benefit Bennett and Denniston’s client –Art Institute.

Detective Eddie Soto also declared three times on tape thatthere was “no crime.” Assault is athreat of violence. If the policebelieved that the defendant made a credible threat of violence, because of theserious nature of the accusation, they would have investigated the case furtherto include a search of the defendant’s home for weapons, a look at hisfinancial records or hard drives for suspicious activity.

Lastly, Bennett and Denniston encouraged its clients toembellish and equivocate the testimony of their clients in order to prevail incourt and defame the reputation of the defendant. Bennett and Dennistonrevealed that the Dean of Student Affairs conducted conduct hearings thatsanctioned the defendant. Bennett and Denniston did not reveal that the ArtInstitute forbids the presence of lawyers and witnesses at these conduct‘hearings.’ Bennett and Denniston did not reveal that the Dean of Students actsas both judge and prosecutor at these conduct hearings. Bennett and Denniston didnot reveal that the Dean of Students routinely excludes evidence submitted bythe student including a response from himself as to the “charges” and ignoresstudent complaints. Bennett and Denniston did not reveal that the Art Institutedoes not follow Equal Opportunity policies that every workplace and schoolacross America follows by law.

The law is a defense against the innocent and the hand ofjustice. It is not a tool to bewielded by the rich and mighty.

Bennett and Denniston may have obtained a judgment for theirclient without violating Rule 5-200. But in obtaining a judgment by violating Rule 5-200, they have unjustlyharmed the defendant denying him sleep, causing anxiety, humiliation anddamaging his reputation. They haveharmed the cause of the plaintiff forever casting it the shadow of infamy andscandal. They have harmed thelegal profession. They havedestabilized the Republic. For if the law can be perverted by the inducementsof lucre and through slight of hand, are any of us safe?

The law is everyone’s business. Those that practice the law must possess and employ thehighest standards of ethics and morality. For how can they seek justice, if they act contrary tothe truth? How can our Republicstand if we tolerate evil dealing within the legal profession?

I respectfully request this august body to investigate theallegations I bring against Bennett and Denniston. If this body validates my claims, I recommend these twolawyers be disbarred. The state ofCalifornia has no shortage of imminently qualified attorneys who are moral andethical.

I spoke with you Monday about meeting with Mayor Richard Bloom over the City Attorney's decision to prosecute me violating the The California Invasion of Privacy Act (1967) and Electronic Surveillance in California (1969).  I met with City Attorney Terry Wright.  He refused to discuss the case.  I met with Detective Soto's supervisor.  We are unable to reach a resolution on this matter.

I am asking Mayor Bloom to order the City Attorney to dismiss the case or meet with me on the record.

The incident is regarding a libelous accusation made by a reality TV actor Andrew McLaren and the Art Institutes alleging I am a domestic terrorist plotting to shoot up the school.  I found such a statement to be an outrage.  I also found Detective Soto's conduct to be lacking discretion and judgment as he appeared to be more of on a fishing expedition than weighing two sides of every

I am a law-abiding citizen with no criminal record.  I previously served in the military in Iraq in combat.  At the time of the recording of the video, I recently learned of the death of my friend Jared Ewy in the line of duty in Afghanistan.  I suffer from Post Traumatic Stress Disorder and am awarded 60% disability from the Veteran’s Administration.

I was in shock of the allegation.  Tape recordings and documentation defend citizens against police entrapment.  Any reasonable person will determine that Detective Soto was on a fishing expedition.
I am previous victim of police brutality.  In March of 2000, Columbus, Georgia police officers beat me and arrested me unlawfully.  In December of 2009, Tucson Police officers unlawfully arrested me.  The word of a police officer always rates higher than a law abiding citizen in a court of law despite police promises that they are here to protect and serve us.
No case law exists that supports Terry Wright's interpretation of Section 632 of the California Penal Code.  If Terry Wright were to prevail in court, the city of Santa Monica would the infamy of prosecuting a comedian for satirizing a police officer in defiance of the First Amendment.  Such a conviction in court would send a chilling effect in government accountability and transparency.  Citizens have a right to taping, recording or otherwise documenting the actions of public officials in the execution of their duty.  Terry Wright's opaque approach to government accountability is antithetical with the highest notions we hold about democracy.  It would also appear as if the City of Santa Monica retaliated against criticism of the city and their police force.  A conviction would expose the City of Santa Monica of an Anti-SLAPP lawsuit (Strategic Lawsuits Against Public Participation.)  It would also appear that City of Santa Monica is not neutral in my legal battle against reality-TV actor Andrew McLaren and the Art Institutes.  It also implies that the City of Santa Monica is willing to use an Al Capone legal strategy to criminalize an innocent man.  The police was unable to get an arrest against me for being a terrorist but will trump up a charge to arrest me by any means possible.  Such an approach flies in the face of centuries of Anglo-American concepts of justice and fair play.

Terry Wright wants to make case law by perverting the law by which it was never intended.  That's immoral.  If he wants to do that, let him prosecute me on his own dime and on his own time.  The city of Santa Monica should not subsidize his odd legal theories.

At 8:00 AM, I reported the Airport Courthouse located at 11701 South La Cienega Blvd. Los Angeles, CA 90045. Commissioner Jane Godfrey heard my case at 11:40 am. My public defender was attorney Marlene C. McNeill. I entered a plea of Not Guilty as to the crime of violating Officer Eddie Soto's privacy on August 1, 2011, a violation of Section 635(a) of the California Penal Code:

(a) Every person who manufactures, assembles, sells, offers for sale, advertises for sale, possesses, transports, imports, or furnishes to another any device which is primarily or exclusively

designed or intended for eavesdropping upon the communication of another, or any device which is primarily or exclusively designed or intended for the unauthorized interception or reception of

communications between cellular radio telephones or between a cellular radio telephone and a landline telephone in violation of Section 632.5, or communications between cordless telephones or

between a cordless telephone and a landline telephone in violation of Section 632.6, shall be punished by a fine not exceeding two thousand five hundred dollars ($2,500), by imprisonment in the county jail not exceeding one year, or in the state prison, or by both that fine and imprisonment. If the person has previously been convicted of a violation of this section, the person shall be punished by a fine not exceeding ten thousand dollars ($10,000), by imprisonment in the county jail not exceeding one year, or in the state prison, or by both that fine and imprisonment.

(b) This section does not apply to either of the following:

(1) An act otherwise prohibited by this section when performed by any of the following:

(A) A communication utility or an officer, employee or agent thereof for the purpose of construction, maintenance, conduct, or operation of, or otherwise incident to the use of, the services or

facilities of the utility.

(B) A state, county, or municipal law enforcement agency or an agency of the federal government.

(C) A person engaged in selling devices specified in subdivision (a) for use by, or resale to, agencies of a foreign government under terms approved by the federal government, communication utilities,

state, county, or municipal law enforcement agencies, or agencies of the federal government.

(2) Possession by a subscriber to communication utility service of a device specified in subdivision (a) furnished by the utility pursuant to its tariffs.

I finally got a copy of the police report. I made my request to the Santa Monica Police Department on September 18, 2011, the day I got my summons to appear from City Attorney Terry White. They refused.

The City Attorney, Terry White, refused to meet or talk with me. He was rather rude and arrogant about it as well.

The Sixth Amendment states:

In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defence

I demanded my Constitutional Right to discovery. The City of Santa Monica has at every turn refused my Constitutional Right to Discovery afforded by the Sixth Amendment.

The Police refused to release the police report. This violates my right to discovery afforded to me by the U.S. and California Constitution.

I asked the Court to grant me a copy of the police report. The prosecuting attorney protested the issuance of this redacted copy even though the Sixth Amendment of the Constitution affords me the right to confront witnesses against me.

The Art Institute employees are Dawn Kohn, Aaron Pompey and Laura Soloff. The anonymous caller was Andrew Gordon McLaren.

Detective Eddie Soto volunteered my criminal history (there was none) to the Art Institute and even provided legal advice to them even though Detective Soto said on tape "There is no crime."

The anonymous caller identified himself as Andrew Gordon McLaren. A former business partner and employee who retaliated against me due to the dissolution of our business relationship. The investigating officer was Officer Eddie Soto.

The Commissioner Jane Godfrey of Division 147, of the Airport Courthouse would not let me speak for myself in court. She said, "You have a lawyer." She pointed to Ms. McNeil. They wanted to wrap up this case so they could take their noon lunch break.

This same woman lectured three defendants including Do (Petty Theft) and Perez (Excessive Noise) for wanting to represent themselves. But when I opted for the public defender, Godfrey shuts me up.

McNeil was patronizing and would not do as I asked her to do which is get the full report, address the court on the motion of full discovery or get the police report not redacted.
